I don’t know about you but I did not grow up wealthy. Talking about money, Wills, and final wishes was just not something our family talked about around the dinner table. As an adult things changed. My circle of friends and colleagues expanded and so did my understanding of why families that strive to leave the next generation better off financially have these conversations and make a plan to leave whatever assets they have to the family members they love instead of the families of companies, governments and state agencies. I have seen and heard the painful stories of those who made a decision not to create a plan to pass their assets on to the next generation and how that greatly affected the emotions, peace, health and finances of the very people they loved and left behind. I did not want that to be the story I left for my children. So before my first child was born we made a plan. When my second child was born we changed it to include her and when life changed again we updated it to reflect our new wishes. Here’s the thing. It was totally unlike what I thought the experience would be. It was comfortable, it was easy, it gave me a sense of peace and a sense of empowerment. I wasn’t going to be lulled into a sense of false security that somehow things would end up the way I wanted if I did not write and notarize my Will and paperwork. 
Without a Will You have no say where your assets such as money in the bank, property, land, cars, jewelry, special items that are of personal importance will go. The court will make that decision and it is likely that you would not have agreed with the decisions they make. Dying without Will is time consuming and costly to your family. The court process is not free and the costs associated with those court costs means less of the value of your assets would go the very people you had every intention of it going to.

The Will ( also known as a Last Will and Testament) component of your Estate plan is a legally binding document that does 3 major things

  •  It allows you to determine who will be your heirs & not a court appointed stranger. Have you heard the stories of aunts, uncles and long lost children coming from near & far to make a claim about what you have worked hard to acquire?
  •  It allows you to determine how you want your assets small or great to be distributed to your heirs. The alternative is for a court to determine who gets what. This is often much more time consuming and more costly than creating a simple Will. YOur Will states what you have and who you wish to bless with those assets or thing. Do you want your daughter to get your Mother’s wedding ring? If so put it in your Will so that your sister-in- law doesnt’ take what you intended for your daughterIt allows you to determine who will be your heirs and not a court appointed stranger. 
  • A Will is a critical document if you have underage children. It outlines who you want to raise your child (Children) if both parents were deceased and unable to raise them. People from court do their best but again would you want a stranger that neither knows your child, family dynamics, parenting styles and values determine who would best raise your child? You get to choose in a Will who would be the guardian of your child(ren).

Your business is essentially a legal entity providing a product or service and as such you have to consider the legal implications of having a business. Just because you are starting out or maybe have not become a household name yet does not mean it is too early to think about covering your legal risks. No one goes into business to tie their personal assets and finances to business related fines, lawsuits or other complications that no one expects but everyone experiences at some level or point in business. Don’t make things complicated but do cover your bases. Here are a few legal requirements for you to consider when starting or being in business. 
  • Start off on the right foot. I can not state often enough that choosing the proper business entity affects so many different areas of your business. The first few things it can affect is your risk for personal liabilit and taxes. Speak to an attorney and tax consultant on the implication of your exposure based on the entirety you choose. 
  •  Check if your business name is available to be use
  • Register your business with the secretary of State.
  • ​Obtain EIN number
  • ​Check if you need any licenses, permits or registrations
  • ​Protect your Intellectual Property. Is it time to trademark or get a patent for the original idea? 
  • ​Communication and unfulfilled expectations are the number one reasons for conflict. Have an attorney create strong contracts on your businesses behalf to avoid conflict and put you in a stronger position if a conflict should arise.
  • ​The bold print giveth and the fine Print taketh away. Have an attorney help you understand what you are signing and agreeing to with your lease and interactions with contractors.
